These Terms of Service ("Terms") govern access to and use of HAZOPNexus (the "Service"), provided by InstruNexus ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent.
HAZOPNexus is a software-as-a-service platform for conducting and documenting Hazard and Operability (HAZOP) studies, Layer of Protection Analysis (LOPA), and Safety Instrumented Function (SIF) / SIL verification, including AI-assisted drafting features. The Service is a documentation and calculation aid for process safety professionals — it does not replace competent engineering judgment, independent verification, or compliance with applicable codes, standards, and regulations.
You must provide accurate registration information and are responsible for all activity under your account, including team member seats you invite. Notify us promptly of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms or applicable law.
Paid plans are billed in advance on a monthly or annual cycle via our payment processors (PayPal, Razorpay). Plan features, module access, and usage limits are described on the Pricing page and may be updated from time to time; material reductions in a paid plan's included features will be communicated in advance. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are governed by our Refund Policy.
You retain ownership of the study data, documents, and other content you upload or create in the Service ("Customer Data"). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Service. You are responsible for ensuring you have the right to upload any content you submit and for the accuracy of the engineering data you enter.
The Service may use third-party AI models to suggest deviations, causes, consequences, safeguards, recommendations, or other content. AI-generated suggestions are drafts only and must be reviewed, verified, and approved by a qualified engineer before being relied upon. We do not warrant the accuracy or completeness of AI-generated content.
You agree not to: (a) reverse-engineer or attempt to extract the Service's source code; (b) use the Service to store or transmit unlawful content; (c) attempt to bypass account, team, or plan-level access restrictions; (d) interfere with the Service's normal operation or security; or (e) use the Service in a way that violates applicable export control, data protection, or safety regulations.
The Service, including its software, design, and branding, is owned by InstruNexus and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding except as needed to use the Service normally.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CALCULATIONS, RISK RANKINGS, OR AI-GENERATED CONTENT WILL BE FREE OF ERROR. THE SERVICE IS A DOCUMENTATION AND CALCULATION AID, NOT A SUBSTITUTE FOR QUALIFIED ENGINEERING REVIEW OR REGULATORY COMPLIANCE VERIFICATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTRUNEXUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS ARISING FROM RELIANCE ON STUDY RESULTS, RISK RANKINGS, SIL VERIFICATION OUTPUTS, OR AI-GENERATED CONTENT PRODUCED USING THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.
You may cancel your subscription at any time from Billing settings. We may suspend or terminate access for breach of these Terms, non-payment, or as required by law. Upon termination, we will retain Customer Data for a reasonable period to allow export, after which it may be deleted in accordance with our data retention practices.
We may update these Terms from time to time. Material changes will be notified via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
